Terms of Service

1. Acceptance of Terms

By accessing or using HeritageCheck AI (“the Service”), operated by Jilinya Pty Ltd, you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service.

2. What the Service Is — and Is Not

HeritageCheck AI provides AI-powered compliance intelligence for Aboriginal heritage obligations in Western Australia, including location checks, register monitoring, and due diligence evidence generation under the Aboriginal Heritage Act 1972 (WA).

The Service is not legal advice. Output from the Service is informational only. You remain solely responsible for your compliance decisions and should consult a qualified legal practitioner or heritage consultant before taking action that could disturb a heritage site or trigger obligations under the AHA 1972, Native Title Act 1993 (Cth), or EPBC Act 1999 (Cth).

3. Accounts

You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity under your account. Notify us immediately at hello@heritagecheck.ai of any unauthorised access.

4. Subscriptions, Billing, and Refunds

Paid plans are billed in advance on a monthly or annual basis. You may cancel at any time from the Billing page; cancellation takes effect at the end of the current billing period. Fees paid are non-refundable except where required by Australian Consumer Law.

5. Acceptable Use

You agree not to: (a) reverse engineer, resell, or wrap the Service as your own; (b) upload content that infringes intellectual property, privacy, or cultural rights; (c) scrape Service outputs at scale without written permission; or (d) use the Service to harass or misrepresent Traditional Owners, Native Title holders, or any third party.

6. Data Sources and Accuracy

The Service aggregates data from public registers including ACHIS, the National Native Title Tribunal, DPLH Heritage Division, and state heritage lists. These sources are maintained by third parties and may contain gaps, delays, or errors. A “clean” result from the Service does not guarantee an area is free of heritage — private heritage surveys are often not publicly registered.

7. AI-Generated Output

Portions of the Service use large language models to summarise, cross-reference, and interpret register data. AI output may contain inaccuracies or hallucinations. You must verify critical information against primary sources before relying on it.

8. Intellectual Property

The Service, including its codebase, design, and brand, is owned by Jilinya Pty Ltd. You retain all rights to content you upload. By using the Service, you grant us a limited licence to process that content to provide the Service to you.

9. Limitation of Liability

To the maximum extent permitted by law, Jilinya Pty Ltd is not liable for indirect, consequential, or incidental damages arising from your use of the Service, including prosecution, fines, or project delays. Our total aggregate liability for any claim will not exceed the fees you paid in the 12 months preceding the claim.

10. Governing Law

These Terms are governed by the laws of Western Australia, Australia. Any dispute will be resolved in the courts of Western Australia.

11. Changes

We may update these Terms from time to time. Material changes will be notified via email or in-app notice at least 14 days before taking effect.
